Personal information which is collected by Investa is used and disclosed for the main purpose for which the information was collected or for related purposes. This may include the following purposes:
- The use for security and safety purposes, including the use of your details in a medical emergency or as lawfully directed or required by a government body.
- The use for the administration and management of Investa.
- To provide customer services to clients and for quality assurance purposes.
- to provide products and services to you and to send communications requested by you;
- to answer enquiries and provide information or advice about existing and new products or services;
- to conduct business processing functions including providing personal information to our related bodies corporate, contractors, service providers or other third parties;
- for the administrative, marketing (including direct marketing), planning, product or service development, quality control and research purposes of Investa, its related bodies corporate, contractors or service providers;
- to provide your updated personal information to our related bodies corporate, contractors or service providers;
- to update our records and keep your contact details up to date;
- Investa may also collect and disclose collected information to earlier and/or future landlord/s or letting agent/s; and
- to process and respond to any complaint made by you.
We may otherwise use or disclose your personal information where the use or disclosure is required or authorised by law (for example, disclosure to government regulatory and law enforcement agencies) or in emergency situations.
If Investa wishes to use or disclose your personal information in other circumstances, we will seek your consent to do so.
We may share an individual’s personal information with our related entities. In this case, the information may only be used or disclosed by the related entity for the main purpose for which it was collected, for purposes related to the main purpose, where needed or authorised by law, or for other purposes if the individual has consented.
Investa does not sell personal information to companies outside the Investa Group.
We may disclose your personal information to our:
- contractors and service providers that assist us in the operation of our business or the provision of services (for example, our internet service providers, cloud computing service providers, applications partners, mailing houses, marketing contractors and providers of any website, portal or share registry); and
- our lawyers, accountants and other professional advisors.
Investa endeavours to ensure that these organisations agree to comply with this Privacy Policy or are otherwise subject to reasonable obligations to protect your personal information.
Our related and associated entities and third-party service providers may be in countries outside of Australia, and which may include the United States, the United Kingdom and India. Our contracts with these parties include an obligation for them to comply with Australian privacy law and our Privacy Policy.
Your rights if you are in the EU
As provided for in the General Data Protection Regulation, you have the right to access your data; to correct or rectify your data; to delete your data subject to applicable law; to have your data processed only in accordance with applicable law; to have copies of your data to be moved to another controller; to object to our processing your data otherwise than in accordance with the law; and to withdraw any consent to our processing your data at any time. Please contact our Privacy Officer to exercise any of those rights.
Marketing
We may send you direct marketing communications and information about our products and services that we consider may be of interest to you. These communications may be sent in various forms, including email, mail, SMS and fax, in accordance with applicable marketing laws.
Express informed consent
You give your express and informed consent to us using your personal information or personal data set out above to provide you with information and to tell you about our products, services or events or any other direct marketing activity (including third party products, services, and events) which we consider may be of interest to you, whether by post, email, SMS or the Indi website or related mobile app (Direct Marketing Communications).
Inferred consent and reasonable expectations of direct marketing.
Without limitation if you have provided inferred or implied consent (e.g. not opting out where an opt-out opportunity has been provided to you) or in the case of Direct Marketing Communications by post, if we have collected your personal information directly from you, and it is within your reasonable expectation that we send you Direct Marketing Communications given the transaction or communication you have had with us, then we may also use your personal information or personal data for the purpose of sending you Direct Marketing Communications which we consider may be of interest to you.
Opt-out.
If at any time you do not wish to receive any further Direct Marketing Communications from us, you may ask us not to send you any further information about products and services and not to disclose your information to other organisations for that purpose. You may do this at any time by using the “unsubscribe” facility included in the Direct Marketing Communication or by contacting us via the details set out at the top of this document.
The Spam Act 2003 (Cth) restricts the circumstances in which Investa can send you commercial electronic messages (including email and SMS text messages). Investa may send other advertising material to you where the advertising material is related to the purpose for which the personal information was collected. You consent to us sending you those direct marketing communications by any of the above methods. If you indicate a preference for a particular method of communication, we will endeavour to use that method wherever practical to do so. If you no longer wish to receive such promotional information from Investa, you may advise us in writing. Commercial electronic messages from Investa will include information about how to contact us and unsubscribe if required. Investa’s records would normally be amended within 30 days or as otherwise required by the Spam Act. Details of how to contact us are set out below.
